CLIENT AGREEMENT

By engaging in my photography/videography services, the client/s agree to the terms outlined in this client agreement by GEORGINA MORRISON CREATIVE (and former subsidiaries, Skout Visual Co. or Georgina Bee), effective upon payment of their deposit or signature of the physical agreement. This agreement ensures clarity, mutual respect, and a shared understanding of expectations and responsibilities.

As the client, it is your responsibility to familiarise yourself with my work before booking me, to ensure you are aware of the aesthetic and style of my work, and to diligently read our contract below before engaging in these services (by either paying your deposit and/or invoice, or signing a physical copy of this agreement prior to making a payment).

TRAVEL

Travel fees are calculated at .80c per kilometre outside a 50km radius of Hamilton VIC 3300 or a designated flat rate/bursary. The total cost will be calculated and added to your invoice. If your session has been booked when I am already in your postcode (for multiple sessions) your travel fee will be reduced to a flat rate.


CANCELLATION + RESCHEDULING

Rescheduled or postponed shoots (due to personal reasons or otherwise) do not incur fees for the first instance if you have paid your 20% deposit. On the second and third instance of a reschedule, an additional 10% deposit will be required each time to secure your place. If you have a photoshoot booked and want to cancel with no intention to reschedule, please notify me a minimum of one month in advance where possible otherwise administration fees may apply. If there are any third-party travel expenses covered by the client that are non-refundable (e.g. flights or accommodation) I will not provide compensation. I do not offer refunds for sessions cancelled within 5 business days that have already been paid in full, and will work with you to find an alternative date (more on Refunds + Reshoots below).


WEATHER

I am conscientious in checking weather forecasts in the fortnight leading up to our photoshoot. Showers and heat under 35 degrees is fine, but in the event that the weather is going to severely impact our session, I will get in touch with you ASAP to work out an alternative date. Rescheduled shoots due to weather do not incur any fees.


DELIVERY

I deliver my photography packages through an online gallery, Pixieset. I will provide you with a pin to download your images – this ensures privacy, and that you're the only one accessing your photos. For packages under 40 photographs, I endeavour to deliver within 10 business days. Packages over 40 – 100, may take up to 2-3 weeks. For Brand and House packages inclusive of photography and videography, please anticipate a turnaround of 4 weeks (depending on peak periods) unless otherwise indicated. For discontinued services like Weddings (ending 12/24), I will endeavour to deliver within 8 weeks (2 months) or upwards of 10-12 weeks in extenuating circumstances or if there are external disruptions. If there is a delay for any reason, I will notify you by email or text (depending on your preference for contact) ASAP. You will be notified of your custom delivery via phone or email, depending on preference. All delivery of packages are final (please refer to REFUNDS below).

PAYMENT

All sessions and gift cards are currently invoiced. Dependent on package size, a 20-30% non-refundable deposit is due no less than 5 days after booking to secure your session, and full payment must be received 72 hours prior to the commencement of your session. Payment must be received by C.O.B on your due date; if your bank delays transfers by 3-5 days, or your company runs on fortnightly pay cycles, you must ensure your amount is processed well in advance to avoid any delay. If there are additional costs (i.e. if you would like to purchase additional photos) these will be calculated afterwards and I will send you a secondary invoice, due 48 hours after.


ALTERATIONS

You are NOT permitted to edit or alter my photographs/videography in any way (such as, use a filter or preset on top of the delivered photos). I always endeavour to work with my clients to achieve the aesthetic that feels authentic to them, and ensure you're happy – but as a photographer with creative liberty, I ask that you please respect my work. I will never give out my RAW files, so please don’t ask. Unsolicited editing is in breach of copyright, and clients requesting/allowing other photographers to edit my photographs is strictly prohibited. If there is a reasonable alteration you would like made to a few select photographs (<10-20 photographs), you must express this within 48hrs of your package delivery, otherwise your request will be denied. Ongoing editing beyond the 48 window incurs additional costs.

RAWs

I never provide RAW files to clients because they are data files, not finished images. Unlike unedited iPhone JPEGs, RAW files require specialised software and expertise to process and edit, ensuring the highest quality and artistic integrity of the final photographs. When you book in for a package, I always stipulate you will receive ‘[X amount] professionally edited, high-resolution photographs’, and at no point, do I ever express you will receive RAW image files. You are not entitled to this version of the product, so please don’t ask.


SOCIAL MEDIA SHARING

Please share your photos and videos to social media (that's what they're meant for!). But please credit me in the caption or tag each time you post, where possible. Instagram @_georginamorrison ; Facebook @georginamorrisoncreative. Pinterest pinning is permitted, but full image credit must be given to @georginamorrisoncreative and the image must not be altered unless you have expressed this intent / I'm aware (e.g. business graphics / isolating subjects in images is okay if previously expressed).


COPYRIGHT

All of my photographs/videography is my intellectual property. While you might purchase a photography package, it does not entitle you to ownership of the photographs; all permissions belong to me. The photos must not be distributed to third parties where they stand to make financial gain (e.g. magazine publication) without written consent from me.

THIRD PARTY USE

Publications, marketing businesses, or any third party companies that seek to use my photographs/videography in any way (without prior agreement) must obtain written permission from me (not by the client/s), and where necessary they must pay the appropriate usage fee (to me, not to you) where financial gain is made from usage. Their failure to do so breaches copyright.

LIVE EVENT VARIABILITY ACKNOWLEDGEMENT

Due to the unpredictability of a live event, you the client, accept that there is a given amount of risk and variability involved in the final product delivered. I, Georgina Morrison Creative, and subsidiaries, acknowledge and promise that I/we will undertake our work to the best of our ability, and will never purposefully create any impediment to the quality of the work. I/we will not take responsibility for interruptions or impediments outside of our control, such as impediments by third-party, that interrupt my/our capacity to complete work to the best of my/our ability. While I/we will do our best to capture your event, I/we cannot guarantee every shot will be taken or delivered.

EXCLUSIVITY

Unless otherwise agreed upon (e.g. hired for videography only) Georgina Morrison Creative (or former subsidiaries, Skout Visual Co., Georgina Bee) are to be the only professional photographer/s and videographer/s employed to take footage at your photoshoot, or event on the day. Failure to adhere to this or notify me of an additional professional photographer on site is an breach of this agreement, and I/we reserve the right to leave site without completion of work, and you will forfeit your payment in its entirety. Family members or staff can take their own iPhone/Smartphone photos and footage in a non-professional capacity of course, but Georgina Morrison Creative (or subsidiaries) must be acknowledged as the only offical photographer and videographer on the day.

REFUNDS + RESHOOTS

I do not offer refunds at all, or waiver invoices if you decide you are not satisfied with the photos or videography. I respect your feedback within reason, and if the client can prove no impediment on their end (e.g. drastically changing the brief or location; far exceeding the agreed upon work when I am already on site; or allowing a third-party to disrupt the capacity of work on site) I will offer a resolution that suits both parties. Limited reediting of up to 20 photographs is possible if necessary. However, any ongoing editing beyond this limit will incur an additional fee and is at my discretion as the photographer (I reserve the right to reject further requests to edit my work).

In the event the client has received value far exceeding what they paid for / their original package, all discussions and negotiations regarding the delivered package will immediately cease.

Unless there have been major technical or environmental impacts that impede the quality of our shoot, I do not offer reshoots. I do my utmost to communicate my branding and style across social media and my website, so my clients are aware of the work I produce.

You the Client, by reading this agreement, making a payment, or signing, acknowledge you have read and accept the Terms & Conditions for Photography and Videography by Georgina Morrison Creative, or any former subsidiaries (Skout Visual Co., Georgina Bee).
